Conex Container Sales
These Terms & Conditions govern the sale, delivery, and use of shipping containers purchased through Conex Container Sales, a trade name and online brand operated by FM Equipment LLC (“Company,” “we,” “us,” or “our”). By placing an order, submitting payment, or accepting delivery, the purchaser (“Buyer”) agrees to the terms below.
1. Container Condition & Intended Use
All containers are sold primarily for storage use unless otherwise stated in writing. Containers may be new or used and may show signs of prior use, including dents, surface rust, scratches, or cosmetic wear.
Condition descriptions (Wind & Watertight, Cargo Worthy, One-Trip) are general classifications. Actual appearance may vary.
2. Limited Condition Warranty (At Time of Delivery)
Wind & Watertight (WWT) Containers
WWT containers are guaranteed to be wind and watertight and structurally sound at the time of delivery only. No warranties apply beyond delivery.
Cargo Worthy (CW) Containers
Cargo Worthy containers are structurally sound and meet cargo-worthy standards at the time of delivery. Cargo Worthy containers are not guaranteed to pass future shipping or CSC inspections.
New / One-Trip Containers
New / One-Trip containers include a limited five (5) year structural warranty covering the container’s primary steel frame and roof against structural failure under normal storage use.
This warranty does not cover:
- Cosmetic condition
- Surface rust or paint
- Normal wear and tear
- Door hardware wear
- Flooring
- Modifications or alterations
- Relocation damage
- Improper placement or misuse
Warranty applies only to the original purchaser and begins on the delivery date.
All containers are sold as-is except as expressly stated above.
3. Warranty Exclusions & Disclaimers
The following are not covered under any warranty:
- Cosmetic appearance
- Surface rust or paint condition
- Normal wear and tear
- Future leaks or corrosion
- Door wear over time
- Modifications or alterations
- Contents stored inside the container
All containers are sold AS-IS except as expressly stated above.
4. Delivery Terms
- Delivery is performed by third-party carriers
- Buyer must ensure clear, level, and safe access
- Exact placement is not guaranteed
- Buyer is responsible for ground conditions
- Buyer is responsible for recovery costs if a truck becomes stuck
- Buyer must be present at delivery unless otherwise agreed
Delays caused by weather, access issues, carrier availability, or site conditions are not the responsibility of the Company.
5. Pricing, Payments & Taxes
- Prices are subject to availability and confirmation
- Delivery pricing is location-based
- Payments may be authorized at checkout and captured after availability and delivery feasibility are confirmed
- Sales tax (if applicable) is calculated at checkout
- Buyer is responsible for all applicable taxes, permits, or governmental fees
6. Cancellations, Returns & Refunds
- Orders may be canceled prior to dispatch, subject to processing fees
- Once a container is dispatched or delivered, all sales are final
- Refused deliveries may result in return transportation and restocking fees
7. Modifications, Permits & Compliance
Buyer is solely responsible for:
- Permits
- Zoning approvals
- Building code compliance
- Engineering requirements
The Company does not provide architectural, engineering, or permitting services unless expressly stated in writing.
8. Limitation of Liability
The Company shall not be liable for:
- Loss or damage to contents
- Indirect or consequential damages
- Loss of use or profits
Liability is limited to the purchase price of the container.
9. Governing Law
These Terms & Conditions are governed by the laws of the State of California. Any disputes shall be resolved in California courts.
10. Legal Entity Disclosure & Entire Agreement
Conex Container Sales is a trade name and online brand operated by FM Equipment LLC, a California limited liability company. All transactions, invoices, and contracts are entered into by FM Equipment LLC.
These Terms & Conditions, together with the invoice and order confirmation, constitute the entire agreement between Buyer and the Company.
